Since 2003, lawyer Duane C. Pozza has dedicated his career to helping clients navigate the often complex legal and regulatory matters of Privacy, Consumer Protection and Advertising Law.
A partner at Wiley Rein LLP since 2018, Pozza also serves as a co-chair of the Washington, D.C., firm’s Privacy, Cyber and Data Governance practice group.
Recognized in The Best Lawyers in America® since 2023 for Advertising Law, Pozza is honored as “Lawyer of the Year” for the same practice area in Washington, D.C., for 2025.
“I don’t believe any one highlight led to my current recognition. I’ve been very active in dealing with the Federal Trade Commission (FTC), where I worked prior to joining Wiley,” Pozza said.
Prior to his start at Wiley Rein LLP, Pozza served as the assistant director in the Division of Financial Practices at the FTC, leading consumer protection efforts in fintech.
“The FTC reviews advertising, marketing and several other commercial practices for compliance with the FTC Act and rules. I’ve been involved in dealing with and resolving FTC matters, and also crafting advocacy to address the many new rules the FTC is proposing.”
An authority on regulations, Pozza has testified before the U.S. House of Representatives Financial Service Committee Fintech Task Force, reviewing data analytics figures, and federal and state privacy laws.
“With constant developments in technology, there’s always something new to address,” he said.
“I enjoy keeping up with new tech and helping clients navigate how both new and old rules might apply to it. As just one example, artificial intelligence (AI) was not a big commercial product just a few years ago, but now companies are eager to figure out how to use and market it,” said Pozza.
An active member of Wiley Rein’s Management Committee and chair of its Diversity, Equity and Inclusion Committee, Pozza understands the diversity and breadth of legal challenges across the industry, from start-ups to Fortune 500 companies.
“It can be difficult for smaller companies, including start-ups, to stay ahead of laws and regulations that can be in flux. While some laws are fairly established, in areas where the law is moving more quickly and it’s complicated, companies with more limited resources can face challenges in understanding regulatory expectations.”
That complexity makes listening an essential skill in advertising law, he said.
“As a lawyer, the ability to listen well to clients, to team members, to other attorneys, can make or break a case. It’s important to listen to and marshal information as part of developing the best solution for clients.”
