Daniel J. Sears, P.C.

Daniel J. Sears, P. C. has represented, primarily, entities and individuals under investigation for, or facing allegations of, criminal misconduct. The emphasis of the firm's practice is criminal defense at the federal level.

Mr. Sears was a deputy district attorney and special prosecutor of organized crime offenses in Pueblo, Colorado from March, 1969 to June, 1972. From June, 1972 to March, 1993, he was a Special Attorney for the U. S. Department of Justice and headed the Office of Drug Abuse Law Enforcement for the District of Colorado. In March, 1993, he was appointed Assistant U. S. Attorney for the District of Colorado and served in that capacity until June, 1975, prosecuting a variety of federal offenses, including complex white collar offenses.

In June, 1975, the Colorado federal judges appointed him to be the first Federal Public Defender for the District of Colorado. In that capacity, he was one of the first seven federal public defenders in the United States. He established the office, and served in that capacity until June, 1979. Prior to leaving office, the United States Supreme Court granted certiorari review in Dunn v. United States, 442 U. S. 100 (1979), an inconsistent declarations perjury prosecution against his client. Mr. Sears argued the case before the High Court in March, 1993, and won an 8 to 0 reversal of his client's conviction with The Honorable Thurgood Marshal writing the unanimous decision.

Since entering private practice in 1979, Mr. Sears has defended a number of business entities, corporate executives, and professional persons who have been charged and prosecuted in high profile cases. He also has prosecuted a number of appeals in the federal courts of appeal, including the United States Supeme Court. He has written a signifcant number of articles for national and local legal publications, and has lectured to law enforcement and defender agencies, and judicial groups.

Mr. Sears has been a Fellow of the Amercian College of Trial Lawyers and served as Colorado State chair for that organization from 1992 to 1994. He served on the Board of Directors of the Faculty of Federal Advocates from 2000 to 2002, and was elected President in 2002. He has been named in Best Lawyers in America (white collar and nonwhite collar criminal defense) for over twenty-five years, and has been listed in Super Lawyers since the inception of that publication.
