Andrew Garnett is the managing partner of Garnett Powell Maximon Barlow & Farbes. Andrew handles all types of commercial litigation with an emphasis on breach of contract, product liability, premises liability, fraud, real estate, toxic torts, and business tort cases. Andrew has tried over 50 jury trials and has handled complex commercial litigation cases from inception through successful oral argument at the 10th Circuit Court of Appeals. Andrew represents Fortune 500 and Fortune 100 companies in state and federal courts across the country.

Andrew is passionate about helping his clients solve their most complex problems. His experience handling all aspects of litigation allows him to understand the critical role of each stage in litigation, from pretrial investigation through trial.

Before co-founding Garnett Powell Maximon Barlow & Farbes, Andrew was a lawyer at Davis Graham & Stubbs LLP and a boutique civil litigation firm in Denver handling complex commercial litigation disputes. He began his legal career as a deputy district attorney at the Denver District Attorney’s Office.

  • Tried over 50 jury trials
  • Won oral argument before the United States Court of Appeals for the Tenth Circuit, which affirmed his successful motion for summary judgment on behalf of BMW North America in a product liability lawsuit (Fischer v. BMW of N.Am., LLC, No. 20-1399, 2021 U.S. App. LEXIS 34785 (10th Cir. Nov. 23, 2021))
  • Obtained dismissal of Subaru Corp. for lack of personal jurisdiction in United States District Court for the District of Colorado (Ditter v. Subaru Corp., No. 20-cv-2908-PAH-MEH, 2022 U.S. Dist. LEXIS 54546 (D. Colo. Mar. 25, 2022))
  • Achieved dismissal of BMW AG for lack of personal jurisdiction in United States District Court for the District of Colorado establishing precedential law concerning the stream of commerce test (Fischer v. BMW of N.Am., LLC, No. 18-cv-120-PAB-MEH, 367 F. Supp. 3d 1178 (D. Colo. 2019))
  • Earned dismissal for Chromalox, Inc. for lack of personal jurisdiction in Chavez v. Xto Energy Inc., Mesa County 19CV30524 (Apr. 26, 2021)
  • Defended fraud action that resulted in dismissal of lawsuit after the United States District Court granted his pre-trial motion to exclude the plaintiff’s alleged physical defect in home sale (Hardy v. Flood, No. 17-cv-677-CMA-NRN, 2019 U.S. Dist. LEXIS 177603 (D. Colo. Oct. 11, 2019))
