As an intellectual property lawyer and a qualified patent and trademark agent, Anna Wilkinson practises in all areas of intellectual property law, with a focus on the procurement of intellectual property rights. Ms. Wilkinson both manages the Canadian portfolios of global filers and acts for Canadian innovative companies and research institutions. She drafts and prosecutes patent applications for medical devices, diagnostics, pharmaceuticals and biologics, materials and nanomaterials, packaging and agricultural products. She is alert to the particular challenges faced by Canadian patentees in the life sciences area and partners with clients to find strategic solutions to the challenges presented by Canadian patent law regarding double patenting, utility and protecting medical methods. Ms. Wilkinson is experienced at customizing patent claims to address the listing requirements for the Patent Register for pharmaceutical patents maintained by the minister of health under the Patented Medicines (Notice of Compliance) Regulations. She provides patent validity, infringement, freedom-to-operate and patentability opinions. She also prosecutes trademark and industrial design applications and performs related opinion work. She is experienced in advanced patent prosecution procedures, including re-examination and reissue proceedings, as well as the solicitors’ aspects of trademark cancellation and opposition proceedings. Ms. Wilkinson is routinely involved in intellectual property due diligence activities and acts in a supporting role in intellectual property litigation. She is the Toronto local chair of our intellectual property group.
