Personal Injury Litigation - Plaintiffs
Glenn is a native Floridian and grew up in the St. Petersburg/Clearwater area. Glenn’s interest in the law grew from his relationship with his grandfather who attended Cornell Law School. His grandfather never took the Bar exam but, instead, became the health Inspector of New York City. Glenn attended the University of Florida for undergraduate and law school. He was on the Honor Court while in law school and was an active member of the Moot Court Team. He graduated from law school with honors.
Glenn began practicing law in 1988 as a defense lawyer with the litigation and trial law firm of Long, Weinberg, Ansley & Wheeler. He primarily represented physicians, hospitals and other healthcare providers in medical malpractice actions, but also handled a variety of other types of cases including insurance disputes, product liability, automobile, and trucking cases. He participated in numerous trials at the firm. In 1993, Glenn began a plaintiff's practice with the firm of Mills & Moraitakis. In 1995, he was named a partner and the firm eventually became Moraitakis & Kushel, LLP. Since then, Glenn and his partner Nick Moraitakis have had a successful partnership representing and fighting for clients who have been injured or killed as a result of the wrongdoing of others.
Throughout his career, Glenn has successfully tried and resolved many cases in areas such as medical malpractice and personal injury. For example, he and his partner Nick Moraitakis argued the case of Keenan v. Plouffe to the Georgia Supreme Court, a case that involved a young woman who was severely brain damaged during a surgery at the Medical College of Georgia. In a landmark decision, the Supreme Court held that the defendant physician, a faculty member at the Medical College, was not immune from suit under the Georgia Tort Claims Act. Instead, he could be held liable individually.
Glenn and his partners successfully handled a significant case against the City of Atlanta and other defendants when their client's husband was killed in a sinkhole that occurred at the Courtyard by Marriott Hotel in Atlanta. After years of litigation, the case was settled for a significant amount shortly before trial.
The firm tried and won a suit against Metropolitan Atlanta Rapid Transit Authority (MARTA) in a negligent security case. The verdict resulted in a one-million-dollar award for their client, the victim of a stabbing at a MARTA station. The medical expenses in the case were under $20,000.00. Another case against MARTA that resolved successfully involved a MARTA bus accident that rendered their client a quadriplegic.
Glenn obtained a favorable verdict in a “no-offer” medical malpractice surgical case in the amount of $4,085,000. The nearly two-week trial sought to hold two surgeons liable for paralyzing Glenn’s client’s stomach during an unnecessary surgery. Glenn has also obtained record settlements involving physicians at the Medical College of Georgia related hospitals including a $7.82 million recovery for a patient rendered brain damaged. More recently, Glenn obtained settlements in two separate cases for the maximum allowed under the Tort Claims Act for both babies and parents ($2 million dollars each, plus additional confidential settlement amounts) in connection with heart surgeries performed on premature babies.
Another high-profile case resolved favorably for the firm’s client involved the death of a young married man and father at a jail who was treated horrifically by the jail’s medical staff. Two nurses involved in the care were criminally indicted. Another recent death case against a large hospital system resulted in a significant confidential settlement. As a result of the patient’s death, the hospital system changed its systemwide ECG overread system in all of its hospitals.
Glenn has successfully litigated and/or tried cases against orthopedists, surgeons, cardiologists, pediatricians, obstetrician-gynecologists, anesthesiologists and other medical specialists. He has a particular interest in nursing home abuse and neglect cases. He has also handled many serious trucking, automobile and premises liability cases. The firm’s automobile product cases have involved defects relating to stability, roof crush, fuel system integrity, seatbacks and seatbelts.
Glenn has presented at seminars and authored papers, articles and a book chapter concerning medical malpractice, Georgia civil practice, nursing home cases, civil justice system and so called “tort reform”, discovery, hospital litigation and trial practice.
Georgia Trial Lawyers Association: In the early 2000s, Glenn worked on behalf of the Georgia Trial Lawyers Association as Legislative Chair helping to defeat efforts to pass tort laws seeking to prevent access to the court system. In 2005, he was elected President of the Association. During his term, he and other Executive Committee members worked to restructure the Association to place a greater emphasis on legislative efforts and outreach and undertook efforts to preserve and protect the civil justice system and citizens' access to the courts.
Glenn is married with two children. Glenn’s interests include spending time with his family, golf, fitness and boating.
