Judith E. "Judy" Posner

Judy Posner is currently a Senior Partner at Benedon & Serlin LLP, and has dedicated more than 25 years to representing clients in the appellate field. Judy handles all types of appeals, writ proceedings, trial consultations, and post-trial motions across a wide range of substantive areas, including personal injury, probate, real estate, contracts, employment, family law, and arbitration. Judy regularly appears before the before the California Court of Appeal and the U.S. Court of Appeals for the Ninth Circuit.

Judy began her career as a judicial law clerk for Judge Melvin Brunetti (dec.) on the United States Court of Appeals for the Ninth Circuit, and later spent more than a decade as a senior judicial attorney at the California Court of Appeal for Presiding Justice Dennis Perluss and Presiding Justice Frances Rothschild. Judy currently serves as the secretary for the California Academy of Appellate Lawyers and is consistently recognized as a Southern California Super Lawyer and by the U.S. News & World Report as one of the Best Lawyers in America in Appellate Law.

Examples of some of Judy’s most prominent cases include:

• Persuaded the California Supreme Court to review two cases involving similar issues on jury trial waiver. Although the Supreme Court ultimately upheld the appellate court’s ruling in the lead case, it acknowledged the conflicting case law and used this specific ruling to disapprove several published appellate opinions supporting the client’s position on relief from jury trial waivers.
  

• Convinced the Court of Appeal to affirm a $58 million personal injury judgment in favor of a veteran and his wife after strategically refuting each of the appellants’ arguments, including issues relating to terminating sanctions, statements of damages, the mandatory and discretionary provisions of Code of Civil Procedure section 473, and the non-economic damages award.
  

• Persuaded the Court of Appeal to affirm a damages award in favor of the Association for Los Angeles Deputy Sheriffs (ALADS) against its president and vice president for breach of their fiduciary duties and allow ALADS to recover $7.8 million in additional damages and costs of proof that had been denied by the trial court.
