Paul T. McGivern K.C.

Paul McGivern is a senior litigator acting exclusively in plaintiffs' medical negligence and infant injury litigation cases. For the past 30 years his practice has been focused on complex catastrophic cases, especially infant birth trauma cases. He is frequently consulted by counsel throughout Canada for his expertise in this area.

Paul is consistently recommended in The Canadian Legal Lexpert® Directory as a leader in medical malpractice cases, and was selected for inclusion in the 2007 (inaugural) and the 2008 through 2016 editions of The Best Lawyers in Canada. He was selected as the 2016 and 2019 Lawyer of the Year for Medical Negligence and the 2020 Lawyer of the Year for Personal Injury. He brings to his practice a unique background of 17 years as medical malpractice defense counsel. He has an impressive reputation for understanding the technically intricate medical and legal issues of complex malpractice actions. After carefully listening to the patient and his/her family, reviewing the medical records, and evaluating the medical and legal issues, Paul will assess, explain and run the case with a view to maximizing the recovery and minimizing the financial risk to the patient and his/her family.

Paul has been lead counsel in hundreds of medical malpractice claims. He has litigated a number of high profile and legal precedent setting cases, and has appeared as lead counsel before every court level in B.C. and in the Supreme Court of Canada, including the recent decisions of Ediger v. Johnston, 2013 SCC 18, [2013] 2 S.C.R. 98 and Cojocaru v. British Columbia Women’s Hospital and Health Centre, 2013 SCC 30, [2013] 2 S.C.R. 357.

In addition to being an advocate for the clients of Pacific Medical Law, Paul was an adjunct legal professor at the University of British Columbia where he taught civil procedure for 18 years. He is also a sought after speaker at continuing medical legal education programs. He has organized and chaired a number of continuing medical and legal programs focusing on medical legal issues. Paul was a Director of the Medical Legal Society of B.C. and is a member of the Trial Lawyers Association of BC and the Plaintiff's Medical Negligence Litigation Group.
