Stewart Eisenberg has earned a reputation of unparalleled success and achievement as one of the region's most accomplished trial lawyers. Eisenberg is a Past President of the Pennsylvania Association for Justice formerly PaTLA (Pennsylvania Trial Lawyers Association) and is a Past President of The Philadelphia Trial Lawyers Association. He serves on the Board of Governors of the American Association for Justice as one of the representatives from the Commonwealth of Pennsylvania. He is a founder and senior partner of the law firm of Eisenberg, Rothweiler, Winkler, Eisenberg & Jeck, P.C., and has represented victims of catastrophic injuries and death for over 30 years. After graduating cum laude in 1976 from the University of Pennsylvania, he attended and graduated from Temple University School of Law in 1980, where he served on the Law Review and received the Barristers Award for Excellence in Trial Advocacy. He has lectured to lawyers at over 50 seminars and continuing education programs, and is the author of numerous articles published in legal periodicals. Since 2010, Eisenberg has been a Visiting Lecturer at Temple University, Beasley School of Law, for the LLM in Trial Advocacy Program.
Eisenberg recently represented construction workers in achieving the biggest settlement on record, $101 million, for a garage collapse at the Tropicana Casino complex in Atlantic City, New Jersey. He has also recently achieved a $3.5 million settlement for family members who were killed when their tire separated from their vehicle on the highway. His first multi-million dollar verdict of $2.4 million was in the landmark case of Feld v. Merrian, where he represented the victims of a brutal criminal assault against the security company and the landlord of an apartment complex for failing to provide adequate security.
His string of multi-million dollar verdicts and settlements has been consistent throughout his distinguished career. A New Jersey woman suffering from dystonia received over $4 million dollars from the doctors and hospital who misdiagnosed her medical condition. An electrical lineman received $5.5 million dollars when he was electrocuted while working above SEPTA railroad tracks. Among other significant jury verdicts was a $3.4 million verdict for a Philadelphia man who was not given antibiotics soon enough after knee surgery and a $2 million dollar verdict for the family of a woman who died after being improperly discharged from an emergency room. In addition, a Philadelphia jury awarded a young boy almost $3 million dollars when Eisenberg represented him for the loss of his mother who died of adrenal carcinoma that was not timely diagnosed. For over two decades, Eisenberg has fought for those who have lost everything. He represented a family that was awarded $4 million dollars for the loss of their mother and unborn baby during childbirth. Another young man was awarded $3.5 million dollars with Eisenberg’s aid after he underwent radiation treatments and then became paralyzed, only to learn a year later that he never had the disease and the treatments were unnecessary. One young woman, ready to get married, was injured and paralyzed by a careless driver and Eisenberg achieved a settlement of over $4 million dollars for her.
Always an advocate for the innocent victim, Eisenberg represented a 6 year old child who received improper nursing care after surgery, was never able to walk again, and was in turn awarded $6.5 million dollars. He also represents victims of automobile accidents who suffer injuries from defects in their cars ($3 million dollars awarded to a child who suffered catastrophic injuries when using a dangerous seatbelt; $8 million dollars awarded to the family of an 8 year old child who was killed, when he was ejected from a defective mini-van; over $6 million dollars awarded to a woman permanently injured when her SUV rolled over in a low speed collision). Eisenberg is on the Board of Directors of the Attorney Information Exchange Group (AIEG) on Crashworthiness.
