Michael was the co-lead counsel in the Yasmin/Yaz birth control litigation and assumed leadership positions in other multi-district litigations involving Ortho Evra and Zyprexa. In 2019, the firm represented grieving families in what has been referred to in the national media as "The Body Parts Case", a case that exposed a nationwide "black market" industry that profits by selling and trafficking human body parts. Since the case began, laws have changed and are continuing to change across the country, most notably in Arizona and Colorado (see §12-140-101, CRS. This case shines a light on a sinister, previously unregulated nationwide industry and sent a message to those running these shops that they can no longer hide in the shadows. The jury awarded $58.5 million to the twelve clients whose claims could be proven at trial, and Burg Simpson is proud of the impact this case has had nationwide in bringing about the much-needed change in state laws so that other families never have to suffer from this again.
Burg Simpson is also a recognized leader in the area of construction defect litigation, representing individual homeowners and homeowner associations across the country. Under the skilled leadership of practice group leaders Mari K Perczak and Craig S Nuss, the construction defect team holds builders accountable to make sure that homeowners do not have to suffer from the consequences of living in poorly constructed homes. Burg Simpson was pleased to announce the Construction Defects Department's recent expansion into the Florida market by opening new offices in Tampa and Sarasota. In 2013, the construction defect team delivered the largest jury verdict in the state of Colorado, and in 2018, shareholders David P. Hersh and Colin Simpson secured one of the largest verdicts ever recorded in Teton County, Wyoming. in 2019, Ms. Mari Perczak was lead trial counsel in a lengthy arbitration where she and her team of construction defect trial lawyers, secured a $19.48 million award for a 17-building, 82-unit residential common-interest, townhome community in Aurora, Colorado. In 2020, Ms. Perczak and the construction defect team obtained a $28.55 million settlement for a Boulder County townhome community experiencing foundation and concrete movement due to swelling soils activated by poor grading and drainage, as well as other defects.
Burg Simpson named shareholder Kerry N. Jardine was instrumental in the firm’s management, practice group formation, global strategy, and direction for nearly 20 years. Mr. Jardine served on the firm's Executive Committee and provided his leadership skills to the firm from the Englewood, Colorado office. Mr. Jardine retired in January of 2022 and Burg Simpson is grateful to him for his many years of leadership and service to the firm.
