Whitney counsels renewable generation developers, independent power producers, power marketers, private equity funds, and institutional investors, among other energy industry participants. She advises on federal energy regulatory considerations related to the development, ownership and operation of electric generation and transmission projects. Whitney routinely counsels clients in their efforts to secure market-based rate authority, as well as certifications for exempt wholesale generator and qualifying facility status and related exemptions and waivers under the Public Utility Holding Company Act of 2005 and the Public Utility Regulatory Policies Act of 1978, respectively.
Whitney also provides federal energy regulatory advice in connection with commercial transactions involving FERC-jurisdictional assets. She conducts regulatory due diligence and helps clients secure approvals for corporate reorganizations, acquisitions, and divestures under Section 203 of the Federal Power Act.
