Find Lawyers in Madrid, Spain for Privacy & Data Protection Law

Practice Area Overview

The Spanish Data Protection Regulations states, among other things, that every organization which deals with personal data in its internal procedures must comply with some obligations. According to this, all organizations have, at least, to (i) register all existing personal data files before the Data Protection Authority; (ii) prepare and approve one or more Security Documents setting the technical and organizational measures regarding the processing of personal data; (iii) prepare certain data processor agreements with third parties which process data on behalf of the data controller; and (iv) review the use, maintenance, and transfer of personal data within the company.

Almost all entities, regardless of their legal form, process a relevant amount of personal data in its activity (including data from employees, customers, video security cameras, among others). For such a purpose, it is worth mentioning that the law affects not only automated computer files but also the files that are kept physically or printed on paper. If a company processes personal data in any way it is, in fact, affected by the law.

As a result, not only technological companies, but also industrial or commercial companies as well as official institutions, devote time and important resources in order to increase the value of the company by using personal data on a smart and organized way.

All companies are somehow obliged to comply with the Spanish regulations above mentioned, as well as European regulations. Therefore, since the entry into force of the General Data Protection regulation (GDPR) in 2016, companies have to adapt their internal processes to a new legal framework that will be fully applicable in 2018.

Data protection lawyers have a strong and comprehensive experience on data protection law. Experts in this field resolve legal issues related to cloud computing, eComerce, social networks, IoT, wearables, etc. Data protection lawyers provide accurate legal advice to companies and represent the client when necessary, during the negotiation of IT agreements or even before the Court.
